Chile's Allende wins Danish literature prize

COPENHAGEN, Denmark (AP) ? Chilean author Isabel Allende has won a Danish literature prize for her "magical and spellbinding storytelling."

The 500,000 kroner ($86,000) Hans Christian Andersen Literature Prize is given to a writer whose works compare with those of the legendary Andersen, who was born in 1805 and wrote about 160 fairytales and poems before his death in 1875.

More than 57 million copies of Allende's books, which incorporate elements of magic and fantasy, have been sold worldwide, most notably "The House of the Spirits," which catapulted her to fame when it was published in 1982.

Prize organizers praised Allende's "mixture of various ages, cultures, forms of knowledge and myths" that have given her storytelling "wingspan and height."

Previous award recipients include Brazilian writer Paulo Coelho and "Harry Potter" creator J.K. Rowling.

A one-time teen al-Qaida fighter?who was also?Guantanamo Bay?s youngest prisoner and last Westerner has been transferred to his native Canada on Saturday, the Canadian government confirmed.

Canadian Public Safety Minister Vic Toews said Omar Khadr, 26, was flown from Guantanamo Bay, Cuba, on Saturday on a U.S. government plane and transferred to Millhaven maximum-security prison in Bath, Ontario.

Khadr's case has been controversial both in Canada and abroad given his age when he was captured, the nature of his detention and hearing, and the reluctance of Canadian officials to accept his return.


"I am satisfied the Correctional Service of Canada can administer Omar Khadr?s sentence in a manner which recognizes the serious nature of the crimes that he has committed and ensure the safety of Canadians is protected during incarceration,? Toews said.

A U.S. war crimes tribunal in 2010 sentenced Khadr to 40 years in prison, although he was expected to serve just a few more years under a deal that included his admission he was an al-Qaida conspirator who murdered a U.S. soldier.

Khadr was 15 when he was captured in 2002 in Afghanistan, and has spent a decade at Guantanamo, the U.S. naval base in Cuba.

Khadr admitted planting 10 roadside bombs in Afghanistan as part of an al-Qaida cell and throwing a grenade that killed an American special forces medic, Sgt. 1st Class Christopher Speer of Albuquerque, N.M.

Over a decade since the war began, TODAY's Lester Holt visits the battlefields outside Kandahar Province and the Horn of Panjwai to see where things stand.

Khadr was the first person since World War II to be prosecuted in a war crimes tribunal for acts committed as a juvenile. He was the youngest prisoner still at Guantanamo, but younger boys were previously held there.

Khadr, born in Toronto, was taken to Afghanistan by his father, Ahmed Said Khadr, himself a senior al-Qaida member and confidant of Osama Bin Laden.

Bin Laden apprenticed the boy to a group of bomb makers who opened fire when U.S. troops came to their compound. Khadr was captured in the firefight, during which he was blinded in one eye and shot twice in the back.

In a written statement, Toews said Canada received Khadr's application for transfer from the United States on April 13. He said U.S. officials assured Canada it would receive a videocopy of an interview with Khadr, but it, along with other videos of interviews and unedited reports, was not sent until this month.

Former Canadian Ambassador Gar Pardy, however, said Canada's Conservative government -- which cultivates an image of being tough on crime -- dragged out the transfer.

"I think the government was mainly very mean-spirited in how it handled the case," Pardy said to CTV News.

Toews said he continues to be concerned that Khadr "idealizes" his father and denies Ahmed Khadr's association with al-Qaida. The Canadian public safety minister said he is also troubled by how "radicalized" Khadr has become from his time in Afghanistan, Pakistan and Guantanamo Bay.

Girls in Afghanistan were not allowed to attend school under Taliban rule, but now millions of girls across the country attend classes. It's a dramatic social change the Taliban is still fighting. NBC's Richard Engel reports.

?From the age of 15 to 26, he has been in some kind of jail, incarcerated. He has had no normal adolescent development at all,? CBC?s Susan Ormiston told CBC News.

Khadr's defense team and human rights groups had argued he was a "child soldier" who should have been sent home long ago for rehabilitation and challenged the notion that a battlefield killing amounted to a war crime.

Khadr was prohibited under the deal from calling witnesses at his sentencing hearing that would support defense claims that he was a "child soldier," forced into fighting the U.S. by a radical father who was an associate of bin Laden.

Khadr's sentence will expire on Oct. 30, 2018.

The U.S. Department of Defense also confirmed Saturday that it transferred Khadr to Canada, leaving 166 detainees at Guantanamo.

In the 2008 presidential election campaign, President Barack Obama promised to close the Guantanamo prison during his term, but that pledge has gone unfulfilled amid security concerns and opposition from Congress, which enacted laws making it more difficult to transfer prisoners from Guantanamo.

Rio Rancho mayor takes heat for church speech

The New Mexico American Civil Liberties Union is criticizing the Mayor of Rio Rancho for holding a speech at a local church.

Mayor Tom Swisstack held his annual ?State of the City? Friday afternoon at the Destiny Center Church, a Christian-based house of worship.

"What it suggests to the public is that the city endorses that particular religious perspective and we don't think governments should be putting themselves in a position where it selects one religion or one denomination over another," said Peter Simsonson, Executive Director of the New Mexico Chapter of the ACLU.

Swisstack said he personally did not pick the venue for the speech. The event?s organizer, the Rio Rancho Regional Chamber of Commerce chose the church, according to Swisstack

?It?s a non-denominational venue and has the acoustics, visuals, and the seating arrangements that are conducive to making this presentation," Swisstack said.

The ACLU argued a speech as important as the "State of the City" should be at a secular building such as a city facility, a high school gym, or even the Santa Ana Star Center.

"In principal, it certainly suggests government is endorsing a particular religious viewpoint and that is strictly forbidden by our Constitution and for good reason," Simonson said.

Another point of contention is that the speech was a paid event. Non-members of the Chamber of Commerce were required to pay $45 to see the mayor deliver the speech.

Swisstack said his speech will be available online at the city?s public website and will be played on the city?s public access channel.

Venice Lagoon research indicates rapid climate change in coastal regions

ScienceDaily (Sep. 28, 2012) ? Research undertaken by the University of Southampton and its associates in Venice has revealed that the sea surface temperature (SST) in coastal regions is rising as much as ten times faster than the global average of 0.13 degrees per decade.

Researchers believe that this is partly as a result of a process known as the 'urban heat island effect'; where regions experiencing rapid industrial and urban expansion produce vast amounts of heat, making the area warmer than its surroundings.

Professor Carl Amos of Ocean and Earth Sciences at the University of Southampton, will be making a speech at the Estuarine & Coastal Sciences Association's Research & Management of Transitional Waters international symposium, in Lithuania on September 27. He explains: "The urban heat island effect is a little considered problem with extreme consequences. Take London for example; the air temperature in the capital and the SST of the Thames is always warmer than it is in the rest of the UK. Similarly, in South Korea, an area which has seen rapid industrial expansion, the SST is rising at a rate of 0.26 degrees per decade -- significantly higher than the global average. Two thirds of this rise is explained by local air temperature, which is largely driven by the urban heat island effect."

The world's coastal zone occupies 18 per cent of the world's land mass and it is estimated that 1.6 billion people live in these regions world-wide. The coastal population density is three times the global average and this population is expected to increase 30 per cent by 2025, with trade and infrastructure at the coasts also increasing steadily. Research suggests that in coastal regions of high urban development, human activity is directly warming adjacent coastal waters and that this contribution to global warming at the coastal zones is equal to, or greater than, other factors such as greenhouse gasses.

Professor Amos, who is based at the National Oceanography Centre Southampton (NOCS) says: "The Marine Climate Change Impacts Partnership Report of 2006 stated that the capacity to define and predict long-term coastal changes due to human causes is 'unknown' and confidence in results is 'low'. This is a major barrier to planning for inevitable changes in coastal SST. Most of these changes at coastlines are caused by human activity, but as it is complex to consider these factors accurately, the official International Panel for Climate Change (IPCC) figures do not take these coastal 'anomalies' into account."

In Venice, with 22 million visitors annually and tourism a year-round source of income, the economy remains critically dependent on the city maintaining its status as one of the world's most desirable destinations. Southampton's research in Venice has highlighted the tension between tourism's economic benefits and environmental repercussions. Analyses of seawater temperature trends in the Venice Lagoon have suggested an increase during winter months ten times greater than that predicted globally by the IPCC -- a result directly linked to tourism.

Thousands of jobs and the Venetian economy rely on the survival of the fishing industry, which is dependent on the temperature of the coastal seawater in the Venice Lagoon. A rise in SST in the coastal zone reduces oxygen levels and displaces marine fish and associated nursery grounds, causing catastrophic fish kill phenomena. This research has helped predict the viability of clam fisheries and aquaculture habitats that serve the restaurant trade that caters for millions of tourists every year.

Professor Amos says: "The findings in Venice are the result of a 15 year partnership with the city, which are of great importance and have worldwide applications. Massive urbanisation of the coastal zones means urban heat islands represent an acute problem, particularly for the fishing industry and also for the maintenance of coastal infrastructure. The Thames, like the Venice Lagoon, is a major contributor to and casualty of the urban heat island effect. The consequences of the urban heat island effect need addressing urgently to secure the future of our coastal habitats."

Auctions are not the only permissible method for disposal of natural resources across sectors, the Supreme Court said holding that the 2G verdict was confined to allocation of spectrum and is not applicable to other resources.

Giving its opinion on the Presidential reference arising out of 2G verdict, a five-judge constitution bench headed by Chief Justice S H Kapadia also ruled that common good is the touchstone for any policy and if it meets that then any means adopted is in accordance with the constitutional principles.

Auction despite being a more ?preferable method? of allotment of natural resources cannot be held to be a constitutional mandate, observed the bench also comprising justices D K Jain, J S Khehar, Dipak Misra and Ranjan Gogoi.

?In our opinion, auction despite being a more preferable method of alienation/allotment of natural resources, cannot be held to be a constitutional requirement or limitation for alienation of all natural resources and therefore, every method other than auction cannot be struck down as ultra-vires the constitutional mandate,? the bench said.

The bench said that auctions may be the best way of maximizing revenue but revenue maximisation may not always be the ultimate motive of the policy and natural resources can be allocated to private companies by other methods for the purpose to subserve public good.

?Common good is the sole guiding factor under Article 39(b) for distribution of natural resources. It is the touchstone of testing whether any policy subserves the common good and if it does, irrespective of the means adopted, it is clearly in accordance with the principle enshrined in the Article,? the bench said.

The apex court referred to various judgements delivered by it earlier while upholding government?s decision to allocate natural resources through means other than auction.

?It is manifest that there is no constitutional mandate in favour of auction under Article 14. The Government has repeatedly deviated from the course of auction and this Court has repeatedly upheld such actions,? the bench said.

It said ?whenever the object of policy is anything but revenue maximization, the Executive is seen to adopt methods other than auction?.

Justice Khehar, who wrote a separate but concurring judgement, said that natural resource should not be dissipated as a matter of charity, donation or endowment, for private exploitation.

?No part of the natural resource can be dissipated as a matter of largess, charity, donation or endowment, for private exploitation.

Each bit of natural resource expended must bring back a reciprocal consideration.

The consideration may be in the nature of earning revenue or may be to best subserve the common good. It may well be the amalgam of the two.

?There cannot be a dissipation of material resources free of cost or at a consideration lower than their actual worth. One set of citizens cannot prosper at the cost of another set of citizens, for that would not be fair or reasonable,? Justice Khehar said.

The court disagreed with the contention that auction should be the only means of allocation as other methods can be abused by the private companies in connivance with government authorities as happened in 2G case.

?It may be said that even auction has a potential of abuse, like any other method of allocation, but that cannot be the basis of declaring it as an unconstitutional methodology either. These drawbacks include cauterisation, winners curse etc?.

?However, all the same, auction cannot be called ultra vires for the said reasons and continues to be an attractive and preferred means of disposal of natural resources especially when revenue maximisation is a priority?.

?Therefore, neither auction, nor any other method of disposal can be held ultra vires the Constitution, merely because of a potential abuse,? the bench said.

The court said that revenue maximisation cannot always be the primary consideration while allocating resources to private companies and assume secondary consideration when the development is the main consideration.

?Revenue maximization is not the only way in which the common good can be subserved. Where revenue maximization is the object of a policy, being considered qua that resource at that point of time to be the best way to subserve the common good, auction would be one of the preferable methods, though not the only method?.
